Dear Ms. Moore:

Please be advised that Bartonville Water Supply Corporation (BWSC) would like to submit this letter, for the record, as our official protest and request for a hearing against the approval of the Re application and proposed project as described.

BWSC is a TCEQ/Superior rated public water supply corporation with a dependence on the freshwater zone ground water available in our area. Our water is produced from nine (9) active wells some of which are 1,600 to 1,700 feet in depth. We are without doubt one of the largest ground water producing public water systems in Denton County serving a population of over 6,000.

Be advised that the Re project is proposed at a location approximately one-half mile from the north western edge of our TCEQ certificated area boundary and in the vicinity of one of our freshwater wells producing 1,000 gallons of water per minute. The Re project is similarly distanced from another TCEQ approved freshwater well we currently have under construction.

As you may be aware, the State of Texas, in conjunction with the County Judge/ Commissioner’s Courts of Denton, Collin and Cooke counties and their pro active efforts to protect this precious resource, recently created the North Texas Ground Water Conservation District. Please don’t thwart their/our efforts. “A House Divided Falls”.

Therefore, BWSC, as a responsible member of this newly created district and in an effort to protect the health and safety of this natural resource and the members/customers we serve and other public and private ground water users like BWSC across the state serve, request the scheduling of a hearing before the Commission to provide testimony by professionals, to support our concerns and subsequent request to deny the Re application/project.
